Regarding our confrontational situation with the Federal DC Court of Appeals re 404 vacatur, per District Judge - R. Moss; was the plaintiff panel of entities aware that Florida has utilized Dr. John D. Tobe’s composed Wetland Delineation Methodology for over the past 20 years? (WEL Blog, March 1, 2023)

Does the plaintiff panel understand last year SCOTUS ruling in “Sackett v. EPA” altered the protections for isolated wetlands.  This alteration was due to no “significant nexus” of water connection to “the waters of the United States.”

If the appeal does not overturn Judge Moss, all wetland delineations in our State will fall into the Corps wetland delineation methodologies EXCLUDING ISOLATED WETLANDS. It is very apparent if this permitting tragedy were to take place the panel of environmental organizations would be the provocateurs.
